These terms govern your use of the Smark website and the launch waitlist. By using this website you accept these terms. Smark is a pre-launch product; the shopping application itself is still being built.

2. The waitlist

Joining the waitlist reserves your place for launch updates. It is free, creates no app account, and does not commit you to any purchase or sale. Waitlist position does not guarantee access to the app at launch.

3. Acceptable use

You agree not to misuse this website: no scraping the waitlist, no attempting to access other people's information, no disrupting the service, and no using Smark branding to mislead others.

4. Intellectual property

The Smark name, logo, website design, and content belong to Smark. You may not copy, redistribute, or reuse them without written permission. See our license page for details.

5. No warranties

This website is provided "as is" while Smark is in development. Features described may change before launch. We do not warrant uninterrupted availability.

6. Limitation of liability

To the extent permitted by Kenyan law, Smark is not liable for indirect or consequential losses arising from use of this website or reliance on pre-launch information.

7. Governing law

These terms are governed by the laws of Kenya. Disputes will be subject to the jurisdiction of Kenyan courts.

8. Changes

We may update these terms as the product evolves. The "last updated" date above reflects the current version; continued use after changes means you accept them.
